These Terms of Service (“Terms”) govern your access to and use of the Unified Health & Fitness website (the “Site”) and any related services, content, and purchases offered through the Site (collectively, the “Services”). By using the Site, you agree to these Terms.

  1. Use of the Site

You agree to use the Site lawfully and not to:

  • violate any applicable law or regulation

  • interfere with or disrupt the Site or its security

  • attempt to gain unauthorized access to any systems

  • misuse forms, email addresses, or content on the Site

We may suspend or restrict access if we reasonably believe you are misusing the Site.

  1. Not medical advice / informational content

Content on this Site is provided for general information and educational purposes only and is not medical advice, diagnosis, or treatment. Always seek guidance from a qualified healthcare provider regarding any medical condition or health-related decision.

If you participate in fitness, training, or wellness services, you understand there are inherent risks, and you agree to participate voluntarily and responsibly.

  1. Services, pricing, and availability

We may change, suspend, or discontinue any part of the Services at any time. Prices, descriptions, and availability of services or products may change without notice (except where prohibited by law). We try to keep information accurate, but we do not guarantee that all descriptions, pricing, or availability are error-free.

  1. Bookings, cancellations, and refunds (24-hour policy)

If you book an appointment, you are reserving time in our schedule.

  • Cancellations/rescheduling: You may cancel or reschedule an appointment with at least 24 hours’ notice before the scheduled start time.

  • Late cancellations: Cancellations made less than 24 hours before the scheduled start time may be charged 100% of the session fee (or may be deducted from a prepaid package/session credit).

  • No-shows: If you do not attend your appointment without notice, you may be charged 100% of the session fee (or the session credit may be forfeited).

  • How to cancel/reschedule: Please contact us at rob@unifiedhealthfitness.com (or use the booking confirmation link, if available).

  • Refunds: Unless otherwise stated in writing, completed sessions are non-refundable. Prepaid packages are non-refundable once started, except where required by law.

Optional:

  • Packages: Package sessions may have an expiry date disclosed at purchase; any unused sessions after expiry may be forfeited.

  1. Payments

Payments may be processed by third-party processors such as Stripe and/or Square. We do not store full payment card details. By making a purchase, you agree to provide accurate billing information and authorize us (and our payment processors) to charge the payment method you provide.

  1. Promotions and third-party tools

We may offer promotions or discounts from time to time, which may be subject to additional terms (expiry dates, limits, non-transferability).

We also use third-party tools (Squarespace, Mailchimp, Google, Meta, Stripe/Square). Your use of those tools may be governed by their own terms and policies.

  1. Intellectual property

All content on the Site—including text, graphics, logos, images, videos, and downloadable materials—is owned by or licensed to Unified Health & Fitness and is protected by intellectual property laws.

You may view, download, and print content for personal, non-commercial use only. You may not reproduce, distribute, modify, sell, or exploit Site content without our written permission.

  1. User content (if you submit reviews, testimonials, forms, or messages)

If you submit content (e.g., testimonials, comments, feedback), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for business purposes (such as marketing), subject to applicable privacy laws and any separate consent you provide.

Do not submit content that is unlawful, defamatory, infringing, or violates someone else’s rights.

  1. Privacy

Your use of the Site is also governed by our Privacy Policy.

  1. Disclaimers

The Site and Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

  1. Limitation of liability

To the maximum extent permitted by law, Unified Health & Fitness will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses arising from or related to your use of the Site or Services.

In any event, our total liability for any claim will not exceed the amount you paid us (if any) in the 3 months prior to the event giving rise to the claim (or the minimum amount permitted by law).

  1. Indemnification

You agree to indemnify and hold harmless Unified Health & Fitness from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms or misuse of the Site.

  1. Governing law and venue

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict of law principles. You agree that any disputes will be brought in the courts located in Ontario, unless otherwise required by applicable law.

  1. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top indicates when changes are made. Continued use of the Site after changes means you accept the revised Terms.
